Three former Commercial Metals Co. (CMC) workers have asked a federal court in Texas to dismiss the company's RICO (Racketeer Influenced and Corrupt Organizations) Act conspiracy charges against the three men.

CMC fired the three men—Mark Chazanow, Michael Uhrick and Mark Wayne—in January and cancelled a contract with MI3 Transportation, a trucking company in which the men or their wives held an interest.
